1. Data controller
SOL Capital Asset Management [PENDIENTE: exact legal name and RUC] ("SOL Capital"), domiciled in San Isidro, Lima, Peru, owns this website and is the controller of the personal data you provide through it, in accordance with Peruvian Law No. 29733, the Personal Data Protection Law, and its implementing regulations.
2. Personal data we collect
This site collects the personal data you provide through the contact form:
- Name
- Email address
- Company or institution
- Selected inquiry type
- The content of your message
- Browsing language (transmitted automatically with the form)
The name, email, inquiry type, and message fields are required in order to handle your request; the company or institution field is optional. Declining to provide the required data only prevents us from processing and responding to your inquiry, with no other consequence.
Additionally, strictly for security and abuse-prevention purposes, we temporarily process — in memory, for a few minutes, with no persistence in our own databases — the IP address from which the form is submitted. Our hosting provider also generates technical server logs that may include IP addresses.
The site does not use analytics, advertising, or tracking cookies of any kind. It relies exclusively on strictly necessary technical cookies — for example, your language preference — which do not require consent under applicable regulation.
3. Purpose of processing
We process your personal data exclusively to:
- Handle and respond to the enquiries you send us through the contact form.
- Manage the relationship with current or prospective investors who request information about the firm or its vehicles.
We do not use your data for advertising purposes, nor do we share it with third parties for such purposes.
4. Legal basis and consent
The processing of your data rests on the free, prior, express, informed, and unequivocal consent you grant when completing and submitting the contact form. You may revoke your consent at any time, without retroactive effect, by writing to sheredia@solxcap.com.
5. Processors and international transfers
To operate this site we rely on providers acting as data processors on behalf of SOL Capital:
- Resend (United States of America): transactional email provider, which processes the contact-form data in order to deliver it to us.
- Vercel (United States of America): hosting provider for the site.
The use of these services involves a cross-border transfer of personal data to the United States of America. Such transfers will be carried out with the corresponding contractual safeguards, so that the providers guarantee adequate levels of protection in accordance with Law No. 29733 and its regulations [PENDIENTE: revisión legal — verify and document Resend's and Vercel's data processing agreements (DPAs), and declare the cross-border flow in the ANPDP databank registration].
6. Retention period
We retain contact-form data for as long as necessary to handle your enquiry and, where a subsequent relationship is established, for as long as that relationship remains in force and for the periods required by applicable regulation. Once the purpose has been fulfilled, the data is deleted or anonymised.
7. ARCO rights
You may at any time exercise your rights of access, rectification, cancellation, and objection (ARCO rights), as well as revoke your consent, by sending a request to sheredia@solxcap.com stating your full name, the right you wish to exercise, and a means of contact for our response. We will handle your request within the time limits established by law.
If you consider that your request has not been properly handled, you may file a claim with the Peruvian National Authority for the Protection of Personal Data (ANPDP).
8. Personal data bank
The data collected through this site is stored in the personal data bank held by SOL Capital [PENDIENTE: inscripción ante la ANPDP — registered name and code of the data bank].
9. Security measures
We apply reasonable technical, organisational, and legal measures to protect your personal data against unauthorised access, alteration, loss, or disclosure, including encryption in transit, access controls, and the minimisation of the data we collect.
10. Minors
This site is directed at institutional and professional investors. We do not knowingly collect personal data from minors. If we become aware that a minor has provided us with personal data, we will delete it.
11. Changes to this policy
We may update this policy to reflect regulatory or operational changes. The current version will be published on this page, together with the date of its last update. Material changes will be communicated in a reasonable manner.
